There are a few instant dismissal offences. The main ones include:
- Stealing from an employer.
- Unlawful acts at work.
- Dishonesty
- Failure to work or to work competently
- Misbehaviour in the course of your work (eg drunkenness)
- Assault of fellow employees.
- Dishonesty.
- Breach of professional standards.
An employer bears the onus of proving that it had a good reason to instantly dismiss an employee. Employees that have been instantly dismissed have no rights to procedural fairness, they have no right to be warned, or to be heard or given an opportunity to respond to allegations concerning conduct which the employer believes amounts to repudiation of the contract.
