Hotel workers hit by AWAsDate: 23 May 2007
The Daily Telegraph's exposure today of the harshness of Australian Workplace Agreement (AWA) templates being promoted by motel employers will come as no surprise to many thousands of workers in the accommodation industry, and their families and dependants. " Employer organisations and associated consultants have been hawking templates in various forms around low-paid industries such as accommodation, hospitality, retail and child care for more than 12 months," LHMU Hospitality Union National Secretary, Jeff Lawrence said. " These templates have become the model for so-called "employee collective agreements" as well as individual AWAs.
Templates provide ways to get around the work laws" Most of the templates have provision for employers to strip away - for no compensation at all - conditions such as penalty rates , roster protections and rest breaks, and other protected minimum award conditions that were supposed to have been "protected by law" under WorkChoices." The template developed by the Hotel, Motel and Accommodation Association (HMAA) exposed by the Daily Telegraph - Motel enforces AWA bra strap ban! - was developed 'in partnership' with the Office of the Employment Advocate (OEA)," Jeff Lawrence said.
Govt relationships help employers push harsh AWAs" The OEA has provided financial and other assistance to the HMAA since 2001 in an effort to increase AWA numbers. "The details of the relationship were revealed in a submission by the Department of Employment and Workplace Relations late last year to a House of Representatives inquiry into tourism workforce issues [see Attachment 7 to the DEWR submission] .
Hospitality workers skeptical about fake fairness tests" The rip-off was lawful under WorkChoices legislation and the OEA's partners exploited the law to the full," Jeff Lawrence said." Hospitality workers and their union are skeptical the new fake fairness test will truly end these rip-offs."
